B2B Service Notice

The Outsourcing Dynamics recruitment service is provided exclusively to business clients (B2B). By engaging our services, you confirm that you are acting in the course of your commercial or professional activity. Consumer protection legislation, including the 14-day right of withdrawal, does not apply to these Terms.

Definitions

General provisions

These Terms govern the use of all services provided by BZmedia under the Outsourcing Dynamics brand, including recruitment services and any associated consulting.

These Terms comply with applicable Polish and EU law, including the Civil Code, the Polish Act on Providing Services by Electronic Means, and the GDPR.

By engaging the Services, the Client confirms they have read and accepted these Terms. These Terms apply to all engagements unless expressly superseded by a written service agreement signed by both parties.

The Services are available exclusively to business entities. By engaging the Services, the Client confirms they are acting in the course of their commercial or professional activity and that consumer protection rules do not apply.

Recruitment service

Outsourcing Dynamics provides a fully managed recruitment and candidate verification service, specialising in sourcing trained specialists — including Video Editors, DM Setters, and Operations Admins — primarily from India via government database audits and AXE stress-test protocols.

Nature of service:

The recruitment service is a contract of best endeavours. BZmedia commits to applying its full methodology to source and vet candidates according to the agreed criteria. BZmedia does not guarantee that any specific candidate will be hired, accept an offer, or remain employed beyond any stated guarantee period.

Briefing and engagement process

All recruitment engagements begin with a paid briefing session during which BZmedia and the Client define the role, compensation range, required skills, and hiring timeline.

Engagement timeline:

BZmedia commences active sourcing immediately upon payment confirmation. Once commenced, the engagement cannot be cancelled and the service fee is non-refundable, as specified in Section 9.

Deliverables and service fulfilment

The primary deliverable of each engagement is a shortlist of assessed, verified candidates presented to the Client, together with AXE Interview Protocol reports for each shortlisted individual.

Client obligations:

Replacement guarantee:

Where a placement guarantee is included in the service tier (as specified in the service agreement), BZmedia will source and present a replacement candidate at no additional cost if the placed candidate leaves within the guarantee period due to reasons within BZmedia’s control. The guarantee is void if the Client changes the agreed role scope, compensation, or working conditions after placement.

Payments

All fees are as stated in the service agreement or the applicable pricing page at the time of engagement. Fees are payable in full before active sourcing commences.

Payments are processed via Stripe. BZmedia does not store card payment data. All card data is handled exclusively by Stripe (PCI DSS Level 1).

All prices are stated in USD unless otherwise agreed in writing. VAT invoices are available on request — please provide billing details at checkout or contact us promptly after payment.

Late payments or failed charges may result in immediate suspension of the active engagement until full payment is received.

Complaints

Complaints must be submitted electronically to: office@outsourcingdynamics.com. A complaint should include the Client’s details, the engagement reference, and a clear description of the issue. BZmedia will acknowledge receipt within 2 business days and provide a substantive response within 14 calendar days.

Where a complaint relates to the quality of the delivered shortlist or the assessment methodology, BZmedia may, at its discretion, conduct an additional round of sourcing or AXE assessment as a remedy.

Refunds and cancellation

No right of withdrawal: The Outsourcing Dynamics service is directed exclusively at B2B clients. Consumer withdrawal rights do not apply. All service fees are non-refundable once active sourcing has commenced.

Pre-commencement cancellation:

If a Client cancels in writing before active sourcing has commenced (i.e., before BZmedia confirms the briefing session is complete and sourcing has begun), a refund of the service fee minus the briefing session cost may be considered at BZmedia’s sole discretion.

Post-commencement:

Once active sourcing has commenced, no refund is available. BZmedia commits to completing the deliverables as agreed. If BZmedia is unable to deliver a shortlist due to circumstances within its control, a credit note for a future engagement will be issued.

Liability

BZmedia is not liable for business results achieved or not achieved by the Client as a result of hiring a candidate sourced through Outsourcing Dynamics. Hiring decisions and employment outcomes are the sole responsibility of the Client.

BZmedia’s total liability for any claim arising from a specific engagement is limited to the fees paid by the Client for that engagement.

BZmedia is not liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of revenue, loss of data, or loss of business opportunity.

BZmedia is not responsible for the conduct, performance, or actions of any candidate after placement, beyond the scope of any applicable replacement guarantee.

Intellectual property

All methodologies, frameworks, assessment tools, and materials used in the delivery of the service — including the AXE Interview Protocol, scoring rubrics, and sourcing processes — are the exclusive intellectual property of BZmedia.

The Client is granted a non-exclusive, non-transferable right to use the assessment reports and candidate shortlists delivered as part of their engagement solely for their internal hiring purposes. Sharing, reproducing, or commercialising BZmedia’s proprietary materials without written consent is strictly prohibited.

Data protection

Personal data is processed by BZmedia in accordance with the GDPR. Detailed rules are set out in the Privacy Policy available at outsourcingdynamics.com/privacy-policy/.

For engagements involving candidate data, BZmedia acts as a data processor on behalf of the Client. A separate Data Processing Agreement (DPA) will be provided to the Client prior to commencement of the engagement.

Termination

BZmedia may suspend or terminate an engagement with immediate effect if the Client:

Upon termination by BZmedia due to Client breach, no refund of fees paid will be issued. Termination does not affect any rights or obligations that have already accrued.

Final provisions

BZmedia reserves the right to amend these Terms. Amendments do not affect engagements already paid for and in progress at the time of amendment. Clients will be notified of material changes by email or via the Website.

These Terms are governed by Polish law. Any disputes shall first be referred to good-faith negotiation. If unresolved within 30 days, disputes will be referred to the court with jurisdiction over BZmedia’s registered seat.

This document does not constitute legal advice. Where a written service agreement exists between BZmedia and the Client, the service agreement takes precedence over these Terms in the event of any conflict.
